TERMS AND CONDITIONS OF THE PROMOTION "VALENTINES 2024"

TERMS AND CONDITIONS OF THE PROMOTION "VALENTINES 2024" (hereinafter referred to as the "Rules").

Preamble

This Promotion is dedicated to stylists - those who run beauty parlours, as well as those who perform nail styling services as employees of beauty parlours or ambassadors.

By organising this Promotion, the Organiser wishes to support smaller entrepreneurs who provide nail styling services on INDIGO NAILS products, both those who run beauty parlours, as well as those who perform nail styling as employees of beauty parlours or ambulant persons.

Under no circumstances is the Promotion intended for entrepreneurs selling cosmetic products, including products of the INDIGO NAILS brand, as part of their business activity(distributors, sub-distributors, wholesalers).

The Promotion is not aimed at entities professionally involved in the sale of cosmetic products, including products of the INDIGO NAILS brand, participating in the Promotion, purchasing products at lower promotional prices, and then selling the products obtained at the lower price at an even higher profit for their sales activity. Such actions are strongly objected to by the Organiser, and consequences shall be drawn against persons who participate in the Promotion even though they do not meet the conditions of participation. 

I. Organiser and duration of discount

  1. The organiser of the Price Reduction "Short Term Price Reduction" (hereinafter referred to as: Reduction) 
    1. via the online shop https://www.indigo-nails.com/ and https://www.indigo-nails.com/eu-de/ is INDIGO NAILS spółka z ograniczoną odpowiedzialnością with its registered office in Łódź, ul. Senatorska 14/16, 93-192 Łódź, entered in the Register of Entrepreneurs by the District Court for Łódź-Śródmieście in Łódź, XX Economic Division of the National Court Register under KRS no.: 0000919132, holding NIP: 7272792881 and REGON: 101805889, share capital: PLN 12,001,303.33, BDO: 000034717 (hereinafter: Organiser 1).
    2. via the online shop https://www.indigo-nails.co.uk is UNITED BEAUTY LIMITED - a company incorporated under the laws of the United Kingdom, registered at Companies House under the number 12076727, VAT: GB332687684, whose registered office is at: 20-22 Wenlock Road, London, England, N1 7GU (hereinafter: the Organiser 2)
  2. The discount shall last from 29 January 2024 at 00:01 (GMT +2) until 22 March 2024 at 23:59 (GMT +2) or until stocks are exhausted or the Organiser cancels the discount (hereinafter: discount duration).

II. General provisions 

  1. The Discount shall take place in accordance with these Terms and Conditions.
  2. Before enrolling in the Discount, the Participant should familiarise him/herself with the Terms and Conditions, in particular the conditions for participating in the Discount. 
  3. By enrolling for the Discount, the Participant acknowledges that they have read and understand the Terms and Conditions and accept all terms of the Discount.

III. Participation in Discount

  1. The Discount is open to the consumer, i.e. the natural person making a legal action under the terms of these terms and conditions, not directly connected to their commercial or professional activity, as well as the trader, i.e. the natural person, legal person and organisational unit referred to in article 33(1) § 1 of the Civil Code, conducting their own commercial or professional activity, subject to the provisions of article 2.
  2. The Discount shall not apply to distributors, sub-distributors of the Organiser, wholesalers and persons who exhibit products in the market place - the above shall also apply to persons who perform a representative function in the aforementioned entities as well as partners in the aforementioned entities. This exclusion does not apply to persons who do not sell cosmetic products on a professional basis and who sell individually or occasionally.
  3. In the event that one of the persons named in point 2 takes part in the Discount, the Organiser shall have the right:
    1. If the order placed under the Discount has not been dispatched - to cancel the order or to claim the difference between the price not covered by the Discount and the price at which the Participant purchased the products under the Discount conditioning the fulfilment of the order on the payment of the difference - depending on the decision of the Organiser;
    2. If the order placed under the Rebate is dispatched, demand the return of the entire order covered by the Rebate or demand the difference between the price not covered by the Rebate and the price at which the Participant purchased the products under the Rebate, depending on the decision of the Organiser; 
  4. In addition, in any of the cases described in paragraph 3, the Organiser may claim from the Participant a refund of the logistical costs related to the fulfilment of the order covered by the Discount in the amount of EUR 3.20 for each item comprising the order.

IV. Discount conditions

  1. The Participant can take part in the Discount by placing an order from the Organiser's online shop during the Discount period.
  2. The Discount applies to orders placed during the Discount period, both in Poland and abroad.
  3. The Discount applies to orders placed during the Discount period in the Organiser's online shop. 1: 
    1. Seventh Heaven - Hand and Foot Scrub 150 g - expiry date: 26 April 2024 at a price of PLN 19 / € 4.50 / $4 instead of PLN 45 / € 11.70 / $10 ;
    2. Drama Queen - Hand and foot scrub 150 g - expiry date: 26 April 2024 priced at 19 PLN / 4.50 € / 4 $ instead of 45 PLN / 11.70 € / 10 $ ;
    3. Cream della Cream - body lotion 300 ml - expiry date: 22 April 2024 priced at PLN 29 / € 6.50 / $ 6 instead of PLN 43 / € 11 / $ 9.
  4. The discount consists in the fact that during the Discount the Participant can buy from the Organiser 2 Cream della Cream - body lotion 300 ml - expiry date: 22 April 2024 at a price of £3.8 instead of £10.60 .
  5. The Organiser stresses that the products included in the Discount have short expiry dates and the Participant, by entering the Discount, confirms that he/she is aware of this fact.
  6. Participation in the Discount is voluntary.
  7. Each Member can place as many orders as they wish during the Discount period.

V. Withdrawal from the sales contract

In the event that generally applicable law grants the Participant the right to withdraw from the sales contract and return the products, the return of products purchased during the Discount shall be possible insofar as they constitute a whole set of new and unused items.

VI. Complaints 

  1. All complaints concerning the manner in which the Discount is conducted should be submitted by email to the Organiser. 
  2. Complaints will be submitted:
    • In the case of Organiser 1 - to reklamacje@indigo-nails.com or by post to the Organiser's registered office address given in section I of the Terms and Conditions,
    • In case of Organizer 2 - to the address: customerservice@indigo-nails.co.uk or by mail to the Organizer's registered office address given in point I of the Rules and Regulations.
  3. The complaint should include the note: "Discount for short expiry date". 
  4. Complaints can be made throughout the duration of the Discount, but no later than 14 days from the date of delivery of the order covered by the Discount.
  5. The complaint should contain the following details of the complainant: name, surname and exact address, as well as a detailed description and reason for the complaint and the complainant's request.
  6. Complaints submitted after the deadline or failing to contain the information referred to in paragraph 6 shall not be considered. The date of sending the complaint shall be deemed to be the date of sending: 
    1. in the case of complaints sent by post - the date of the postmark on the parcel containing the complaint; 
    2. in the case of complaints sent by e-mail - the date of confirmation of receipt of e-mail by the Organiser.
  7. Complaints will be considered immediately, however no later than within 14 days of their receipt by the Organiser.

VII. Personal data protection

  1. The administrator of the personal data of Discount Participants is the Organiser.
  2. The personal data collected in connection with the Discount will be processed for the purpose of fulfilling the order, for accounting purposes, as well as for asserting and defending claims resulting from the Sales Agreement - on the basis of the Administrator's legitimate legal interest in asserting and defending claims.
  3. The Participants' personal data may be disclosed to entities supporting the Organiser in the implementation of the Discount, including in particular marketing agencies, courier companies, the Polish Post Office, a law firm, an accounting office.
  4. In connection with the Organiser's processing of personal data, Participants have the following rights: 
    1. the right of access to the data and the right to request their rectification, erasure or restriction of their processing; 
    2. The right to transfer the personal data provided to another controller; 
    3. The right to object to the processing of the data.
  5. Participants also have the right to lodge a complaint with the President of the Office for Personal Data Protection.
  6. The personal data of Discount Participants will be stored for the period during which it will be possible to make complaints and, in the case of complaints, for the time necessary to consider the complaint, until the statute of limitations for claims.
  7. The provision of personal data is voluntary, however, it is a prerequisite for the fulfilment of the order. The consequence of failing to provide personal data will therefore be the impossibility of processing the order.

VIII. Final provisions

  1. These Terms and Conditions are available for the entire duration of the Discount on the following websites: https://www.indigo-nails.com/ and https://www.indigo-nails.com/eu-de/. 
  2. The Discount applies from the day the Discount begins.
  3. Order processing times can be extended during the Discount period.
  4. By taking part in the Discount, the Participant accepts the terms of the Discount and declares that he or she is familiar with the Discount rules laid down in these Terms and Conditions and has no objections thereto. 
  5. Each Organiser reserves the right to amend these Terms and Conditions during the Term of the Discount, without giving any reason, with the proviso that entitlements acquired by Participants prior to the amendment shall be respected. In particular, the Organiser reserves the right to reduce the duration of the Discount or to exclude individual items from the Discount as a result of stock-outs. The Organiser may make such a decision separately. Each Promoter shall run the Promotion separately and shall be responsible for it independently.
