Terms and conditions of the "-15% Newsletter" Discount Code

I. Organiser and duration

  1. The organiser of the promotional action "-15% Newsletter" (hereinafter: "Promotion") is United Beauty Ltd, VAT No. 332 6876 84, (hereinafter: Indigo Nails/Organiser).
  2. The Promotion will run from 09.10.2023 from 24.00 (GMT +1) until stocks last or the Promoter cancels the Promotion, (hereinafter: Promotion duration).

 

II. Terms and Conditions of the Promotion

  1. The Promotion shall be open to consumers, i.e. regular customers making a legal act under the terms of these Terms and Condi-ons, not directly related to their business or professional activity, as well as entrepreneurs, i.e. regular customers, legal persons and organisational units referred to in Article 331 § 1 of the Civil Code, conducting a business or professional activity on their own behalf (hereinafter: Participant).
  2. The Organiser stipulates that the Promotion cannot be participated in by:
    • Contractors of the Organiser, including distributors, sub-distributors, wholesalers, 
    • Persons who have the status of a seller on the Marketplace platform - except in individual cases, with prior consultation with the Organiser and with the Organiser's prior consent to the above;
    • all entities running a drugstore business.
  3. The Participant takes part in the Promotion by placing an order at the Indigo Nails online shop at https://www.indigo-nails.co.uk during the Promotion period.
  4. The Promotion applies to orders placed during the Promotion both within and outside the UK.
  5. The Participant undertakes that he/she will not resell the Products covered by the Promotion to any extent, especially within the Participant's business. In the event of a breach of the above provision, the Organiser shall have the right to claim reimbursement from the Participant for the value of the Products that the Participant purchased under the Promotion, to which the Participant, by accepting the Terms and Conditions and taking part in the Promotion, agrees.

 

III. Promotion rules

  1. Participation in the Promotion is possible after the Par0cipant has subscribed to the Indigo Nails newsletter (by providing his/her email address and accepting the required marketing consents).
  2. The Promotion consists in the fact that the Promotion Participant, after fulfilling the conditions specified in these Terms and Conditions, will be able to buy products from the Indigo Nails brand offer with a discount of -15%, calculated from the retail price - excluding: certain devices i.e. lamp and e-files and promotional product bundles.
  3. After signing up for the newsletter, the Promotion Participant will receive a promotional code of -15% via email to the email address he/she provided.
  4. The discount code received via email will be redeemable only for registered users, after logging into the Indigo Nails online shop https://www.indigo-nails.co.uk.
  5. The promotional code can only be received to the indicated e-mail address once. It is not possible to unsubscribe from the newsletter and subscribe to it again in order to receive the discount code using the same e-mail address. Furthermore, you can only receive one code for the same person, company (email, phone, company details). In other words, after unsubscribing from the newsletter and signing up again from the same email, phone number, using the same company details, the Promotion Participant will not receive the discount code again.
  6. The discount code sent to the Promotion Participant's email address will be usable once. 
  7. The Promotion does not combine with other offers.
  8. Participants wishing to participate in the Promotion are recommended by the Organiser to take action in the following order:
    • creating an account;
    • sign up for the newsletter

    or

    • signing up for the newsletter directly when registering an account.
  9. The discount code is unlimited. If the User encounters problems with the ability to use the code, it is necessary to contact the Organiser. Then, after contacting the Organiser and confirming that the code has not been used before, the Organiser will provide the Participant with a new valid code. , Indigo Nails reserves the right to change these Terms and Conditions during the Promotion, without giving any reason, with the proviso that the rights acquired by the Participants before the change will be respected. In particular, Indigo Nails reserves the right to shorten the duration of the Promotion or to exclude individual items from the Promotion as a result of running out of stock.

 

IV. Complaints 

  1. All complaints regarding the way in which the Promotion is carried out and the provision of the discount code shall be submitted by Participants by email to customerservice@indigo-nails.co.uk or by post to the Organiser's registered office, i.e. Poland, Lodz 93-192, ul. Senatorska 14/16 , with the annotation: "15% Newsletter- complaint", for the entire duration of the Promotion, however not later than 14 days from the date of its termination.
  2. The complaint should contain the following data of the person making the complaint: first name, surname and the exact address, as well as the exact description and reason for the complaint and the claim of the person making the complaint.
  3. Complaints submitted after the deadline or not containing the information referred to in paragraph 2 shall not be considered. The date of sending the complaint shall be the date on which the Organiser confirmed the receipt of the complaint - in case of complaints submitted electronically, and the date of postmark on the parcel containing the complaint - in case of complaints submitted in writing.
  4. Complaints shall be considered immediately, however no later than within 14 days of their receipt by the Organiser.
  5. In the event that provisions of generally applicable law grant the Participant the right to return, the return of products purchased in the Promotion shall be possible insofar as they constitute a whole set of new and unused items purchased in the Promotion. The return may be executed by the Customer only against the Organiser within the meaning of point I item 1 of the Terms and Conditions.

 

V. Protection of personal data

  1. The Administrator of the Promotion Participants' personal data is the Organiser.
  2. The personal data collected in connection with the Promotion shall be processed for the purpose of completing the order, for accounting purposes, as well as for the purpose of pursuing claims and defending against claims under the Sales Agreement - on the basis of the Administrator's justified legal interest in pursuing claims and defending against claims.
  3. The Participants' personal data may be disclosed to entities supporting the Organiser in the implementation of the Promotion, including in particular marketing agencies, courier companies, the Polish Post.
  4. In relation to the processing of personal data by the Organiser, Participants shall have the following rights: a. The right to access the data and the right to request its rectification, erasure or restriction of its processing; b. The right to transfer the provided personal data to another administrator; c. The right to object to the processing of the data.
  5. Participants also have the right to lodge a complaint with the President of the Office for Personal Data Protection.
  6. The Promotion Participants' personal data shall be stored for the period during which it is possible to make a complaint, and in the case of a complaint - for the time necessary to handle the complaint.
  7. Providing personal data is voluntary, however, it is a necessary condition for the fulfilment of the order. The consequence of failing to provide personal data will therefore be the impossibility of fulfilling the order.



VI. Final provisions

  1. These Terms and Conditions are available throughout the Promotion on the website https://www.indigo-nails.co.uk. 
  2. The Regulations shall come into force on the date the Promotion starts.
  3. During the Promotion period the lead time for orders may be extended.
  4. By taking part in the Promotion, the Participant accepts its rules contained in these Terms and Conditions and declares that he/she has familiarised himself/herself with the Promotion and does not raise any objections in this respect.
